We respect intellectual property and expect our customers and Printers to do the same. Customers must only upload designs they created or are licensed to have printed for pay.
Report copyright infringement
If you believe a file on Mandarin 3D, or a part we made, infringes your copyright, send a written notice to our designated agent:
Copyright Agent, Exon Enterprise LLC (doing business as Mandarin 3D) Jacksonville, Florida Email: ryan@mandarin3d.com, with "DMCA" in the subject line
Our registration of a designated agent with the U.S. Copyright Office is pending. Until it is listed, send notices by email as above.
Your notice must include (17 U.S.C. 512(c)(3)):
- Your physical or electronic signature.
- The copyrighted work you say is infringed.
- The material you say is infringing and enough information for us to find it (for example the order number, file name or a link).
- Your name, address, phone number and email.
- A statement that you believe in good faith the use isn't authorized by you, your agent or the law.
- A statement that the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
Knowingly false notices can make you liable for damages (17 U.S.C. 512(f)).
What we do with a valid notice
- Remove or disable access to the file, and pause any order made from it that hasn't shipped yet.
- Tell the customer who uploaded it, with a copy of the notice.
- Record the notice against the customer.
Counter-notice
If you believe your file was removed by mistake or misidentification, send our agent a counter-notice with:
- Your physical or electronic signature.
- The material removed and where it was before removal.
- A statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, if outside the U.S., any district where we may be found), and that you'll accept service from the person who sent the notice.
We'll forward it to the person who sent the notice. If they don't tell us within 10 business days that they've filed a lawsuit, we'll restore the file within 10–14 business days after receiving your counter-notice.
Repeat infringers
We count a "strike" for each valid notice against a customer that isn't successfully countered. After three strikes in any 12 months we refuse that customer's future orders, and we may do so sooner for clear or deliberate infringement. Printers who copy, share or reuse customer files are removed immediately.
Trademarks, patents and other rights
The DMCA covers only copyright. To report a trademark, patent, design right or other IP problem, email ryan@mandarin3d.com with the same details as above (your right, the item, and your contact details). We review these by hand and may cancel orders or remove files.
Customers' own designs
If you think a Printer or anyone else misused a design you uploaded to Mandarin 3D, email ryan@mandarin3d.com right away. Printers are bound to keep files confidential, delete them after shipping and never print extra copies.
